The suit was filed on Monday in the U.S. District Court in Maryland and is being brought by a man named Martin Goettl, who said his Surface 2 tablet cracked in two places within four months of buying it.

Goettl was also one of the many people who called into a Microsoft support line to complain about the product last month, when The Verge was able to catch one call while it was happening. The call came in to a Microsoft support line between July 31 and August 2.

"I have had my Surface 2 for almost four months and have used it every day. Today, I decided to start charging it and it cracked in two places," Goettl wrote in the lawsuit. "This is unacceptable, particularly as a Surface 2 with a plastic back, it's really a piece of junk."

Goettl's suit is the second filed against Microsoft in the last three weeks. The first, filed by a woman in Massachusetts, is focused on the Surface Pro 2 tablet and the Surface 2 Pro. That lawsuit was also filed on Monday.

Both lawsuits ask for damages and have filed against Microsoft's Surface division in the U.S., which has led to legal action against Microsoft and the Surface maker.
